There\nare 1500 \u201cRights of Way\u201d in Fife, with probably a third of these being\nincorrect. A basic \u2018rule of thumb\u2019 is that if a route has been in existence for\n20 years, then it has become a \u201cRight of Way\u201d. <\/p>\n\n\n\n<p>The first route under consideration was between\nStation Road and Braehead. There is no record of this being a \u201cRight of Way\u201d\nbut would come under the category of 20 year usage. However the route has\nbecome dangerous due to work done by the owner of the property adjacent in\nStation Road in clearing the ground for his view from his windows. This has\nprobably been the case for five years. Although the route has a long history,\nit would be difficult to prove that the owner had cleared the area with the\nintention of preventing the right of way. However the work has left the route\ndangerous and unsafe for pedestrians. The owner would have no statutory duty to\nremove any blockage or return the route to its original state. The onus would\nbe on the community to prove there was intention to block the route or\ndeliberately to make it unsafe. If the community was to decide to make the\nroute safe it may cost in the region of \u00a320,000. It would be for the Community\nCouncil to consider whether this was considered a priority. Peter Copland,\nChair of the Community Council, who was present, agreed to take the matter back\nto the CC. <\/p>\n\n\n\n<p>The second route under consideration was at\nVirgin Square where vehicles could at times be parked \u201cunhelpfully\u201d for\npedestrians, but it was not a \u201cRight of Way\u201d. Owners could be asked to remove\ntheir obstructing vehicles but that was all.<\/p>\n\n\n\n<p>Sarah and Robert were thanked for their helpful\nclarification and advice, and left the meeting.<\/p>\n\n\n\n<p><strong>Group Walkabout Action Plan update\/subsequent\nissues \u2013 Kara Watson (Housing Officer)<\/strong><\/p>\n\n\n\n<p>KW gave an update on the <strong>Walkabout<\/strong> which took place on 17<sup>th<\/sup> April 2019. <\/p>\n\n\n\n<p>The following matters are now \u201c<strong>complete<\/strong>\u201d, meaning either action has\nbeen taken or cannot be taken any further. (<em>This\nis in addition to other matters shown as \u201ccomplete\u201d in earlier minutes<\/em>).<\/p>\n\n\n\n<p>Fencing at Coastal Path<\/p>\n\n\n\n<p>The following are matters raised <strong>subsequent to the Walkabout<\/strong> and are now\n\u201c<strong>complete<\/strong>\u201d. <\/p>\n\n\n\n<p>Damaged Railings beside 41\nInverie Street &nbsp;<\/p>\n\n\n\n<p>The following is <strong>on-going from Walk-about<\/strong><\/p>\n\n\n\n<p>Caravans parked at Miller\nTerrace \u2013 one caravan has been removed, but another\none still there<\/p>\n\n\n\n<p>Hope Place\/Miller Terrace\nsignage for car parking \u2013 Transportation contacted; still\non Stuart Goodfellow\u201ds \u2018to do list\u2019<\/p>\n\n\n\n<p>St Monans Coastal Path Sign \u2013 FCCT contacted; in the process of updating\ninformation<\/p>\n\n\n\n<p>3 East Shore Street \u201cprivate\nparking\u201d sign \u2013 ownership checked;\nHarbourmaster property; Transportation being chased up \u2013 question over\nenforcement<\/p>\n\n\n\n<p>Station Road\/Hope Place\nrailings \u2013 Transportation contacted; made safe, but post\non pavement needs fixed <\/p>\n\n\n\n<p>East Street Noticeboard area \u2013 HW indicated that he had met with a number\nof \u201cinterested parties\u201d and would call a meeting in the next few weeks to hear\nconcerns and possible solutions. There are issues of continuing maintenance\nwhich would lie with the community. However he believed there were probably\nmore things in common that might lead to an amicable solution.<\/p>\n\n\n\n<p>Road-surfacing throughout St\nMonans \u2013 Transportation contacted (Sara Wilson) \u2013 it\nwas reported that work would commence in East Street and the \u201cDawsie\u201d in\nMarch\/April 2020<\/p>\n\n\n\n<p>The following is <strong>on-going subsequent to Walk-about<\/strong><\/p>\n\n\n\n<p>Bins at Braid Court \u2013 Kara updated meeting; uplift ordered, and\nproject approved to replace fencing<\/p>\n\n\n\n<p>Railings at Johnstons Close \u2013 an inspection has been ordered<\/p>\n\n\n\n<p>Right of Way at Station\nRoad\/Braehead corner \u2013 note earlier discussion<\/p>\n\n\n\n<p>Broken posts needing to be\ncapped \u2013 HW showed photos of posts at the Harbour,\ncorner of Hope Place and Station Road, beside the Town Hall in Hope Place, and\npost at the corner of West End and West Shore; KW would pursue these<\/p>\n\n\n\n<p>Defibrillator at\nHarbourmaster\u2019s Office and painting of Office<\/p>\n\n\n\n<p>Uncut hedges on lane beside\nschool \u2013 KW reported that action was to be taken\neither to cut back or remove altogether by End of October\/start of November<\/p>\n\n\n\n<p><strong>Other Matters from Minute<\/strong><\/p>\n\n\n\n<p>HW encouraged the meeting to support the St\nMonans Common Play Area Proposals which Helen Ironside (Welly Boot Club) had\nshown to him. The costs would be around \u00a3120,000. Funding would need to be\nfound from various sources including work by the community to fund raise. <\/p>\n\n\n\n<p><strong>Other Business from the meeting<\/strong><\/p>\n\n\n\n<p>A garden at the corner of Inverie Street and\nCastle Street was overgrown. KW would look into this.<\/p>\n\n\n\n<p>SM reported that a resident in Gourlay Crescent\nwas concerned about fencing around her property. KW advised that this was\n\u201ccoming\u201d.<\/p>\n\n\n\n<p>RG intimated the next Federation Meeting in\nCupar on 27<sup>th<\/sup> September at 10.30am<\/p>\n\n\n\n<p><strong>Next Meeting<\/strong><\/p>\n\n\n\n<p>There being no further business the Chair\nthanked those who had come, and intimated that the next meeting of the\nAssociation would take place on Wednesday 16<sup>th<\/sup> October 2019 at\n6.30pm at the Masonic Lodge, Braehead.
